TERMS OF SERVICE PROSPECT EXCHANGE (PE)



1.  WHY IS THIS INFORMATION PROVIDED?

The protection of your personal data is important to DHL Group. We would therefore like to inform you about the conditions under which your personal data is processed within the framework of the Prospect Exchange (PE). The Basic Data Protection Regulation (GDPR) and, where applicable, other statutory provisions are applied. 

2.  WHAT IS THE PROSPECT EXCHANGE (PE)?

DHL Group's Prospect Exchange is a platform that allows you to upload your candidate profile and, if applicable, further information about you. You can specify your interest in a suitable position at a Group company according to your skills and wishes. Recruiters evaluate your candidate profile and submit suitable job offers to you.   

3.  HOW IS YOUR DATA PROCESSED WITHIN THE FRAMEWORK OF THE PROSPECT EXCHANGE?

a.  Your candidate profile 
You are required to provide basic personal data in order to allow us to provide you the services within prospect PE platform, such as your name, address, telephone number or e-mail address. In addition, you have the option of providing information about your previous professional career or education. Furthermore, you can store your language skills and select the language in which we will communicate with you. 

b.  Your requirement for a suitable position
You have the opportunity to provide information regarding possible job offers, 
  • which specific areas you are interested in, 
  • whether you are actively or passively searching, 
  • the type of employment you are looking for,
  • what your salary expectations would be
  • from when or how quickly you would be available, 
  • what would be your preferred job location,, e.g. city, country, continent 

c.  Visibility of the data
Your data will be used for the purpose of contacting you about a suitable position which meets your specification regarding the position of your interest.  Your data will only be visible to recruiters from DHL Group Companies based on your chosen preferences. If a DHL Group company recruiter considers you for a suitable position, data may be passed on to the other recruiters based on your chosen preferences so that an initial assessment of a fit can be made.

d.  Our job offer
When a recruiter of the DHL Group Company would consider you for a suitable position, he or she will contact you to discuss the potential opportunity and might send you the job description and invitation to apply. If the offer finds your interest, we would be pleased to receive your application for the position offered. You can use your saved profile data for the application and add to or correct it.

e.  Availability of your data
As soon as your data have been stored on the Prospect Exchange platform for 11 months, you will receive an automated notice. The notice will give you a choice to continue to be listed as a potential candidate for a position in DHL Group. We will also use this opportunity to ask you to update your profile. If you do not agree within the 1 month to an extension of the data retention period for another 12 months, your data will be deleted. You can of course be re-included in the list of prospects at any time. 

4.  DATA PROTECTION NOTICE

a.  Legal grounds for the processing of your data
We process your data on the legal grounds of the consent(s) you have given us in order to
  • inform you about suitable job offers of our Group companies according to the search criteria (category, location),
  • provide you information about DHL Group or the Group Company as required, and
  • (if desired) come to an exchange with you to get to know you better.
In addition, we may prepare process statistics and derive other non-personal evaluations in order to optimize internal processes. If there are reasons arising from your particular situation that could conflict with processing based on the aforementioned legitimate interests, you have the right to object to this by sending your objection to the e-mail address below. 

b.  Consent(s)
By uploading your candidate profile and setting your preferences for job offers, you agree that recruiters from relevant Group companies may contact you and send you job offers.
You can revoke your consent at any time by deleting your uploaded candidate profile or by contacting the "central contact point" for the processing of interested parties' requests at the e-mail address Avature_Helpdesk@dpdhl.com.

c.  Responsible
Deutsche Post AG (Charles-de-Gaulle-Str. 20, 53113 Bonn, Germany) is the parent company of DHL Group. Together with numerous Group companies, it operates the Prospect Exchange platform. Each Group company is (jointly) responsible in accordance with the GDPR. Their agreement on Joint Responsibility for the PE is available under PE-Agreement.

d.  Your rights under the GDPR
You can exercise the following rights of the GDPR at any time by contacting the central contact point at Avature_Helpdesk@dpdhl.com.
  • Access 
  • Rectification
  • Data portability
  • Withdraw the consent
  • Object
  • Erasure
  • Right to lodge a complaint. If you have any question about data protection, you can contact the data protection officer of Deutsche Post AG (email: data-protection@dpdhl.com). If you believe that your data is or has been improperly processed, you can lodge a complaint to the data protection supervisory authority responsible for you.
  • Waiver of future contact. If you no longer wish to be included in the Prospect Exchange platform in the future nor would like to be contacted in this regard, please inform us of this via the above-mentioned email. We will then mark your name and the email address you used accordingly.

5.  CHANGE OF THESE TERMS OF SERVICE

The content of these Terms of Service is dated 1 August 2020 and will be reviewed regularly. We reserve the right to change them at any time without notice. 

6.  PE-AGREEMENT



1.  Background
The DHL Group companies listed below jointly operate an "Prospect Exchange (PE)" for people who would like to work for DHL Group. Prospects can upload their profile in accordance with the terms of service and thus make it available to recruiters from the Group companies for checking and contacting, depending on the desired segmentation. Recruiters shall send job offers to prospects and invite them to apply for the advertised position. After the consent of the prospect has been obtained, information about the Group or individual job offers will be sent to them, they will be contacted in order to precise their candidate profile. This information should help in offering more specific job offers to the prospect.
 



2.  Purpose and means of joint processing of profiles of prospects
The group companies operating the PE are joint controllers within the meaning of Art. 26 GDPR. For the purpose described above, they use the services of a service provider with whom they have concluded a data protection agreement (Controller-Processor Agreement). 


3.  Basis of the processing operations
Controller process information of prospects on the basis of the consents granted pursuant to Article 6 sec. 1 lit. a GDPR. This entitles each (joint) controller to carry out data processing within the scope of the segmentation defined by the prospects, such as in particular access to the profiles of prospects and their evaluation.
Based on respective granted consent the controllers may be allowed to send information and/or to contact prospects in order to improve the chances of the prospect’s placement.


4.  Rights of data subjects (as required in GDPR)
After the registration and submitting prospect’s profile to the PE tool he/she will receive a confirmation email including the PE Terms of Service, the specified segmentation and the essence of this agreement. Prospects are requested to assert their rights under the GDPR vis-à-vis the “single contact point” who can be reached via email “Avature_Helpdesk@dpdhl.com” established at Deutsche Post AG.
